How we work
A clear process in a critical moment.
We know that when you come to Immigrateful, time is short and uncertainty is high. That is why our process is designed to be direct, transparent, and focused on what matters most: acting before the deadline expires.
The process step by step
- 01
Initial consultation
The first step is a consultation with the attorney. In that consultation we review the judge's decision, identify the legal grounds for appeal, and clearly explain what to expect from the BIA process.
- 02
Case evaluation
We review the hearing transcript, the judge's decision, and any relevant evidence. We identify the legal errors that can support the appeal and communicate our honest assessment of the strengths and weaknesses of the case.
- 03
Filing the EOIR-26
If you decide to proceed, we file the Notice of Appeal (EOIR-26) with the BIA within the 30-calendar-day deadline from the judge's decision. This step is the most urgent: without the EOIR-26 filed on time, the removal order becomes final.
Deadline: 30 calendar days from the judge's decision.
- 04
Drafting the legal brief
Once the EOIR-26 is filed, the BIA sets a deadline to file the legal brief. In that document we argue in detail the judge's errors, cite applicable case law, and present the legal grounds for the appeal.
- 05
BIA follow-up
We monitor the status of the case before the BIA, respond to any court requests, and keep you informed about the progress of the process. BIA processing times vary depending on the complexity of the case and the Board's workload, and are subject to change.
- 06
BIA decision
The BIA can affirm the judge's decision (you lose the appeal), overturn it (you win and may obtain the relief requested), or remand the case to the immigration judge for reconsideration. We accompany you through each of those scenarios.

Fees
Our fee for a BIA appeal is $5,000, payable in two stages.
- $3,000on signing the representation agreement. We file your appeal with the Board within 3 business days and send you the written case strategy within 14 days of filing. Both steps are included in the first payment.
- $2,000on the day the Board issues the briefing schedule. We then write and file your brief.
When the government appeals a decision you already won, the fee is $4,000, in three stages. It is a different schedule, not a discount. A motion to reopen in the immigration court for an in-absentia removal order is separate work under a separate agreement: $3,000, one stage.
The Board's filing fee — $1,060 for a notice of appeal filed on or after 1 October 2026 — is not a firm fee. It belongs to you and is paid directly to EOIR; no part of it goes to the firm. The amount is set by the schedule in force on the day of filing, so confirm it with us if time has passed since your consultation. When the government files the appeal, this fee is not charged to you — it is tied to the form the government files.
There is no deposit or upfront payment. You are never asked for more than the next stage, and we do not charge for a stage we have not completed. Exact fees are confirmed in writing in the representation agreement before you sign anything.
Not sure you can pay the Board fee? The Board has a form to request a fee waiver. Answer a few questions and we will show whether your situation resembles the one the form is designed for. The Board decides, not us.

Questions about the process
How much does a consultation cost?
The first consultation is free. In that call we review your situation and explain whether you have grounds to appeal. Fees for a BIA appeal are $5,000, payable in two stages. They are explained in detail before you sign anything.
Can you represent me if I am not in Florida?
Yes. Immigration law is federal. Immigrateful can represent you in any state in the U.S., regardless of where you are or where your hearing was held.
What do I need for the initial consultation?
The most useful thing is to have the exact date of the judge's decision and any court documents you have available. If you do not have documents, we can still talk — the important thing is to act before the deadline expires.
Can I hire Immigrateful if the 30 days have already passed?
In very limited cases, the BIA may accept a late appeal if there were exceptional circumstances. Contact us immediately to evaluate your specific situation.
What happens to my work permit during the appeal?
If the appeal is pending before the BIA, you can generally keep and renew your EAD. This is one of the most important benefits of appealing on time.
Ready to get started?
If the hearing was recent, do not wait. Every day that passes is one less day to file the appeal.
