BIA Appeals

The Most Common Grounds for a Successful BIA Appeal

Not every removal order should be appealed — but many should. Here are the legal and factual grounds that most often lead to BIA reversals or remands, and how to identify them in your case.

The Most Common Grounds for a Successful BIA Appeal
Not every removal order is wrong. But a significant number of them are — and the Board of Immigration Appeals exists precisely to correct those errors. Understanding the grounds on which the BIA can reverse or remand a decision is essential for anyone considering an appeal. This is not about re-arguing your case from scratch. It is about identifying specific, articulable errors that the immigration judge made — and explaining why those errors matter. Here are the most common grounds that lead to successful BIA appeals. ## 1. Legal Error: The Judge Applied the Wrong Standard Immigration law is complex, and immigration judges sometimes apply the wrong legal standard when evaluating a case. Common examples include: - **Asylum credibility determinations** — applying an incorrect standard for assessing whether an applicant's testimony was credible - **Nexus errors** — failing to correctly analyse whether persecution was "on account of" a protected ground (race, religion, nationality, political opinion, or particular social group) - **Particular social group definition** — incorrectly defining or refusing to recognise a cognisable particular social group - **Withholding of removal standard** — confusing the standard for withholding of removal with the standard for asylum When an immigration judge applies the wrong legal test, the BIA can reverse the decision or remand it for reconsideration under the correct standard. ## 2. Factual Error: The Judge's Findings Were Not Supported by the Record Immigration judges must base their decisions on the evidence in the record. When a judge makes a factual finding that is not supported by — or directly contradicts — the evidence, that is grounds for appeal. Examples include: - Finding that an applicant was not credible despite consistent, corroborated testimony - Ignoring or mischaracterising country condition evidence - Making factual findings about the applicant's home country that are contradicted by the record The BIA reviews factual findings under a "clearly erroneous" standard — meaning the error must be clear from the record, not merely a matter of the BIA weighing evidence differently. But clear errors do occur, and they are appealable. ## 3. Due Process Violations Every person in immigration proceedings — regardless of status — has due process rights. Violations of those rights are serious grounds for appeal. Common due process issues include: - **Inadequate interpretation** — the interpreter made significant errors that affected the applicant's ability to present their case - **Denial of continuance** — the judge refused to grant additional time to obtain evidence or retain counsel, and that refusal was unreasonable - **Denial of the right to present evidence** — the judge excluded relevant evidence without adequate justification - **Bias or appearance of bias** — the judge's conduct during the hearing suggested prejudgment or hostility Due process violations can be particularly powerful grounds for appeal because they go to the fundamental fairness of the proceeding. ## 4. Ineffective Assistance of Prior Counsel If your previous attorney made serious errors that prejudiced your case, you may be able to raise an ineffective assistance of counsel claim on appeal. This is a recognised ground before the BIA, but it requires following a specific procedural framework established in *Matter of Lozada*: - You must file a complaint against the prior attorney with the relevant bar authority (or explain why you did not) - You must give the prior attorney an opportunity to respond - You must show that the attorney's errors were prejudicial — that is, that the outcome might have been different but for those errors This ground is available but procedurally demanding. It requires careful documentation and legal argument. ## 5. Changed Country Conditions If conditions in your home country have changed significantly since your original hearing — in a way that is relevant to your claim for relief — that may support a motion to reopen rather than a direct appeal. However, in some cases, country condition evidence that was available but not properly considered at the hearing can be raised on direct appeal. Country condition evidence is particularly relevant in asylum, withholding of removal, and Convention Against Torture cases. ## 6. The Judge Failed to Consider All Available Relief Immigration judges are required to consider all forms of relief for which an applicant appears eligible. If the judge failed to consider a form of relief — or denied it without adequate analysis — that is grounds for appeal. Examples include: - Failing to consider cancellation of removal for a long-term resident - Failing to consider Convention Against Torture protection - Failing to consider adjustment of status through a qualifying family member ## How to Identify the Grounds in Your Case Identifying the strongest grounds for appeal requires a careful review of: - The full transcript of every hearing - All evidence submitted - The judge's oral and written decision - Applicable case law This is why BIA appeals require an attorney with specific appellate experience. The grounds are not always obvious from a summary of the case — they emerge from a close reading of the record. ## A Note on Realistic Expectations Not every case has strong grounds for appeal. An honest BIA appeal attorney will tell you if your grounds are weak — and explain what that means for your options. The goal is not to file an appeal for its own sake, but to identify whether there is a genuine legal argument that the BIA should hear. --- *Immigrateful focuses exclusively on BIA appeals.
